Do you have to go to court second time to evict tenant?
In June went to court(NJ) to evict tenant, agreed to a deal for tenant to stay by paying extra money each month to cover past due rent. Now tenant is about two months behind. Do I have to go to court again, or I could just tell the court and they will evict the tenant. Because I already went to court, and do not wish to wait for court date and pay again for lawyer etc.

Sorry, but by accepting rent and making a deal, your original eviction is now void. You will have to start again. You might, however, be able to bundle the costs of the first eviction along with everything else should you decide to pursue a judgment against the tenant. Additionally, you might think about offering the guy some sort of incentive to leave peacefully on his own. The costs you save along with being able to quickly re-rent it to someone who will pay might be worth letting them break the lease early without penalties if they just move out now.

IM FROM CALIFORNIA BUT MY UNDERSTANDING IS THAT EACH TIME RENT IS PAID IN FULL AND AS AGREED AND YOU STOP THE EVICTION PROCEEDING........ AND THEN THERE IS A BREAK IN THE RENTAL AGREEMENT BY THE TENANT.......( NOT PAYING RENT AGAIN.........) IT IS A NEW PROCESS OF EVICTION AS THE LANDLORD......AND YOU HAVE TO START OVER AGAIN......... BUT I WOULD SEE WHAT NJ 'S LAW IS........ BEST WISHES........

I would think yu would have to start the process all over again but I would call a lawyer for a free question with this question on monday. talk to the tenant tell him you don't want to have to evict him but when can he pay you the 2 moths rent? good luck
