my landlord hasn't collected rent for november yet?
There have been indications that he is behind or not paying the mortgage. Someone was taking pictures of the house this summer that was contracted by the bank. He received mail at our address from attorneys and his mortgage somehow got our number and called looking for him. they have no number or address for him and neither do we.I have seen him in a brand new SUV! They were still under the impression that he still lived in the house.(duplex) We haven't as of yet been notified by the bank. today is the 7th,if he doesn't come by tonight I'm assuming he's letting the house go.he's always here by the 3rd and likes to collect his money! as i stated above, we he is unreachable and besides that I'm not chasing my landlord down, if wants his rent he can come and get it period.! second, it is my business to know if my family and I are going to get evicted soon because some jerk didn't make the mortgage payments with the rent he was receiving! To you "WILDCAT",NO ONE WAS ASKING FOR SYMPATHY,IT WAS A QUESTION,SO GET OFF YOUR HIGH HORSE AND I NEVER SAID I WASNT GOING TO PAY RENT! SOUNDS AS IF YOU'RE MONEY HUNGRY TOO!! GOOD DAY.

Assume nothing. Just hang onto the check and don't spend the money otherwise. Leave it in the bank to cover the check, just in case. If you don't have a lease you might want to consider looking for a mew place now. If you do have a lease you must honor it, as there is no clause to let you out of it on the supposition the landlord MIGHT be behind in his payments. You'll have enough notice if the place does go into foreclosure, because even if the bank takes over they still have to formally evict you. If you want to be proactive you could approach the bank (since the landlord is not available) and see if they want to work out a deal for you to buy the place cheap.

This might sound mean but it is really none of your business other than the fact you need a place to live. So I would focus on that and by that I mean, make plans for the possibility that the home you live in might foreclose and find an alternative place or places to live. Also you have the responsibility to ensure your rent is paid. I do not know what state you live it but the state of California requires the renter to insure the rent is paid. In other words it is your responsibility even if he does not come around and collect the money himself, to get the money to him. Other than that all this other stuff does not concern you. As mean as this must sound what I am saying here will help protect your credit rating if you make sure the rent is paid. A good credit rating helps you in buying your own home later in life. Edit Update: I see that you did not like my honesty. I did not say what you wanted to hear and that is fine.

Weather or not he has paid the mortgage is none of your business until it gets to foreclosure and that can take months. Not paying the mortgage is NOT illegal and does NOT give you grounds not to pay the rent. Just because he is late picking it up also does NOT mean that he will not. He could just be busy. It is only the 6th!! Calling him names will NOT get you any sympathy!!!! If it does go to foreclosure the new federal law requires that the bank let you live out your lease if you have one or give you 90 days notice if you do not. They cannot just kick you out any more. So pull your head out of your a$$ and chill out!!! Also - you are legally required to pay him the rent until the day the bank takes possession. Then you pay rent to the bank. If he does not come to get it then you need to put it aside for him because if you do not have it when he does come then you will be evicted.
