Question

10 points!! how do I get the insurance company to settle quickly?

I was rear ended about a month ago, and injured my back. The seat I was sitting in actually bent sideways. My medical bills have come out to about ten thousand dollars, which is only my ER and ambulance bills. I am willing to settle this for just the cost of my medical bills, and I would've thought that they would be eager to settle before i accrue any more bills or hire an attorney, because Im sure they know I could sue them for much more than what I am asking for. I just want it to be over with. Can anyone who has been through this sort of thing give me any advice on how to get them to settle quickly? They have already accepted 100% liability for the accident. (she hit me going 55 and I was at a complete stop if that matters at all) Thank you, and as always no rude or pointless answers and I will award best answer :) I was actually in a rental car, which was totaled and that was paid off to the company within the next week after the accident.

The most important thing, or one of them is how much insurance does the other party have on their insurance policy for bodily injury? You can only ask up to their limit with her insurance company. In CA the minimum requirement is $15,000 per person. And the $15,000 includes medical bills and pain and suffering settlements. $15,000 is the maximum amount that would be paid out if you carry that limit. I don't know what the minimum requirement is in your state. You might want to post what state your in for more help. Getting an attorney may be a good idea. But knowing what limit the other party has on their insurance would really help but I don't know if they will be willing to release that info to you. And, the insurance does not pay out until you tell them you have finished all your medical treatment. So, until you tell them your done, they will not be offering you a "pain and suffering" settlement. Good Luck.

Are you in contact with the other party's insurance? I would think that if you told them to just cover your bills that it would be over with very quickly. Was your car fixed or replaced? I don't know, seems odd that it's not settled already.

They could be dragging their feet in your best interest. Accident injuries do not go away over night, especially in your back. If you already accrued over $10,000, you will probably have a lot more coming. If you want to settle because hospitals are demanding payment, you can just tell them that your injuries were related to a car accident, in most cases, they will go after the other party's insurance for payment.

YOUR AGENT can help you out with this. What you're entitled to, is going to depend heavily on state law. Some states you ALWAYS collect your medical under your own policy, period. Even if you were in a rental. If you're talking any serious money - like more than a couple thousand - they're NOT going to settle quickly, unless it's for WAY under what they think they might have to pay. They're going to wait until you're fully healed, to see what your permanent disability might be, and the extent of the injuries are. You don't mention what your actual injuries are, either - that's very material, along with the state you are in, and what the medical bills consist of - chiro bills are HEAVILY discounted.
