How can I get the deed back to my home?

I don't pay the mortgage on a home in Florida, but I signed the deed over to a relative. She hasn't paid the rent in 6 months and the bank is about to foreclose on the house.We made an agreement that even though the home was financed under my name she was responsible to pay every month. She refuses to sign over the deed back to me so that I may take ownership of the home. She was not able to fiance the home due to her bad credit. Now she 100% refuses to pay the mortga gand give me back the deed. What are my options? We only had a vebral contract, there is no written contract.

What a mess Why on earth did you give her the deed? If she had/has bad credit, what you should have done was keep the deed in your name (since the obligation of the mortgage was on your back) and wrote up a lease option for a 2 to 3 year term so she could get her finances in order and try to get her own mortgage at that time. By giving her the deed but still having the responsibility of the mortgage in your name, you have essentially screwed yourself. You have NO rights to what happens to this property. That's unfortunate. Better consult an attorney to see if you have a leg to stand on. I think you are going to be foreclosed and not be able to get this deed back in your name. NEVER sign over a deed unless the person buying your house is getting their own loan! Only other way deeds are transferred is if you are doing a contract for deed or a land contract sale. Let me guess, you didn't use the expertise of an attorney to write up or look over this deal? If you had, they would have told you to stay a million miles away from it!
