How to file small claims court for tenant who moved out 2 months early & did not pay last 2 rent in NV?
Tenant moved out almost 2 mos early w/o telling landlord of exact move-out date & didn't pay last 2 mos rent, which as I understand, they are still contractually-bound to do. Also, there was damage to property which the security deposit will be needed to repair. How do I go about getting the last 2 months rent (total $2,600, damage to property exceeds security deposit but I will forgo that) in Las Vegas, Nevada? Can the judge "make" the tenant pay if ruled in my favor? Or do I have to somehow garnish her wages? I know her SS# & school where she works. Also, technically, my mother is the landlord but since she lives out of state, she wants me to handle this matter. Can I legally act on her behalf? I don't want the tenant to get away unpunished bc what she did is so unfair! Step by step, what do I do & is there a time limit to doing this? Thx!

If you live in the Area where this occurred, then you go to the court house, and file a petition to the court for Small Claims (under 5,000) Loss of Rental income, and damages not covered by security deposit. And you must present a notarized letter of agency (that you are acting on your Mothers behalf and are authorized to file a suit for loss of rental income and damages to rental property. You can expect this take 6 months for a court date, landlords/others in LV are very active. You should have all pictures of rental before and after (showing damages) you should have rental agreement filled out and last payments made and how your Mother found out that the renters had left. This only works if rental property is registered in your Mothers name, and she pays taxes on the rental income.
