Landlady is overcharging my rent? Help!?
i have been living in a single tenancy room with my boyfriend and my landlady found out. I have paid my rent amounting to 350 pounds on the 23rd September 2009 (which should covers the rent from 23rd Sep to 23rd October 2009). She came on the 6th of October 2009 demanding an early rent or charge for my boyfriend for living here amounting to 350 pounds (which should cover 23rd October to 23rd November 2009). I gave her notice to leave on 22nd October saying that i will be leaving on 22nd of November. She still have my deposit and she came here yesterday saying that i will still have to pay rent for november and that my deposit covers the damage costs that might be incurred. Is she allowed to charge for my boyfriend? and do i pay her the last months rent although technically i have already paid her? Help!

It depends on the tenancy agreement you signed. What does that say. Is your room for single occupation only? I think yes you do have to pay her for the last month as you paid for 23rd Sep - 23rd Oct and not until 22nd Nov. Regarding your boyfriend, I am inclined to say she can charge you as it is her room and she can do whatever she wants. Make sure everything is fixed and nothing is broken or anything so she has to give you your deposit back - However I must warn you, she sounds like someone who will point out the smallest detail and keep your deposit, so have your wits about you.

You'll have to read you tennacy agreement, it might be for single occupancy in which case she can charge you for your boy friend. Do you have to pay for the next month, yep looks like it. You should get your deposit back if the place is immaculate though, so don't trash it.

I believe that the lease must specify the amount of people allowed to live there before she can charge for additional people. Do not pay the November rent let her use the security deposit for November as long as you know that there are no damages she will have to take from the deposit. I would not normally recommend this; however, in this situation it is pretty clear that she is not going to give you your security deposit back.

I agree with Rob G, you MUST see someone at the citizens advice bureau for legal advice. Afterall its free. Whatever you do, DO NOT withhold rent you owe for the last month. You will get into soooo much trouble if you do that.

If you broke the rules of your tenancy agreement by having your partner stay then you will have to pay the extra. As for being charged the amount of rent it will depend on what you signed in your tenancy agreement.

The Land Lady does not intend to lose any money, and about the security deposit you gave her when you moved in, consider it a 'gift' to her, once you have friction between you and the landlord, there will be a reason or damage found that surpasses the deposit. Forget about it and move on. It is her property and she initially rented only to you, so yes she can and will charge you,
