Building 2 Houses on 1 10 acre piece of property?
Our parents have a house and barns on 10.2 acres of land zoned agricultural. They want to give us 5 acres to build a home on. How can we best do this and still give both parties the benefit of the agricultural tax break on the property (which in Ohio is anything above 10 acres.) Can we build our house on the property and keep the land in our parents name? Do we have to split into 2 parcels?

you can hedge a bit; do not build a formal house; but instead, a barn type building with a mini kitchen and sleeping area. AFTER it has been permitted by the county, then, expand it KNOWING that your expansions might have to be removed or re-permitted later.

I don't think it is possible. If the land is subdivided, you will lose the designation of zoned agricultural. If the land is not subdivided, you won't get title to it and therefore you won't be able to get any loans in your name. There may also be an issue of two families permanently living in two different homes even if it isn't subdivided on the same farm which could cause the loss of the zoning.
