Question

What to do about getting security deposit back?

I rented an apt in missouri and had a one year lease. Before my lease ended, I gave them a written 30 day notice that I would be moving with my forwarding address. I also cleaned the apt from top to bottom and took pics when I left.~I did every thing my lease required step by step. It has been 30 days and I still have not received my deposit back. Is this normal? I asked about my deposit when I left and they told me that I would be getting my deposit back, but it would be sent in a check to my forwarding address. ..they have already rented the apt out again, so I feel like I should already have my money. Yes I was there for the entire year, so I did not breach my lease.

Your deposit should have been put into a scheme as Landlord have to do this by law (in UK anyway). If you know what scheme it has been put in to, contact them to try and get it back. If not contact your landlord and ask what the delay is. Was this not discussed when you handed the property back over when you left?

Just to confirm you were there for the entire year, correct? If not then you probably won't be getting the deposit back. If you were there through the entire lease I would send them a letter requesting the deposit back.

Get in contact with the landlord one last time and inform them that so far you've received no word on why they might not have returned your deposit and that if they don't return it to you within the next 14 days you'll be taking further action. If no joy, then you need to pursue a small claim. It may be enough simply to issue your former landlord with the papers to have them very swiftly send you a check. In a civil court it will be up to your landlord to provide evidence that they rightly retained your deposit because of cleanliness issues or other damage.

NO! This is not normal. Some states give 45 days for the return of the deposit so you need to check if Missouri is one of those states. If it is not then they have lost all right to your deposit and you need to sue them for it. Before you can sue however, the law requires that you send them a demand letter. EDIT: Verbally asking about it does not count. It needs to be in writing. Sending it certified is best. That way you have legal proof they got it. Also, the date a new tenant moves in has nothing to do with this. A new tenant could move in the day after you move out and they still legally have 30 days to refund your deposit.

"It has been 30 days and I still have not received my deposit back. Is this normal?" I live in CA. 21 days is the law in CA and all but once did I get my deposit back in that time frame. The last time I moved out it took them 150 days. But they did not pay me the $800 I put down less the $200 to clean the place. The judge made them pay me $2,400 because they had no valid excuse for taking that long. Treble damages are great!
