How are they going to garnish wages when I don't have a job?

I am full time + student, I have student loans but am not working. I am being sued by Capital One for less than $900. What else can they "take" if I don't have wages they can garnish?

Non-existent wages cannot be garnished...so they can't do anything there. The judgement would allow them to freeze your checking account and take any money out. When you start working, the outstanding judgement would take effect and then they would start taking money from your paycheck. On the court date, DO NOT be a no-show under any circumstances whatsoever. People often make the HUGE mistake of not showing up because they think they’d loose anyway or because they can’t afford an attorney. Not showing up is the worst thing you can possibly do. Even if you are frightened....or you're sick with a 102 degree fever...or if you think that you'd loose, show up anyway! If you don't, the other side will get a default judgement and they will get this on THEIR terms. They will tack on all sorts of add-on fees and the amount of the judgment could end up being two or three times the actual amount of the debt...so if you want a judgement against you for 3 times that actual amount of debt...be sure to stay home and watch TV on the court date. IMPORTANT: bring complete documentation of your being unemployed and living expenses: Pay stubs and copies of bills. If you have a bank account, they can ask court for judgment against that. Make some token payments 5/10 a month and promise to pay more when you get a job. Pay w/money order. If they accept payment, they cannot get judgment.

Dusty is WRONG. A five dollar payment isn't going to stop a lawsuit. If someone owes me $900 and I'm suing them that doesn't stop the suit, duh! I agree with CatDog (although it looks like he just copy and pasted his answer from a previous posts he used). Show up for court. Plead your case. Ask them to prove it's really your account. Definitely file a response. Show up for court. Well if they get a default judgement? They can put it on your credit report *goodbye good credit*, plus it could cause you to be at risk for applying for more student loans. Also they can garnish your wages *if it's legal in your state* whenever you get a job, plus they can find any accounts and try to get the money. I would suggest getting a job or some source of income. There are many people who are full time and work full time or part time jobs. (If that's possible for you. If not then don't buy stuff on credit that you know you cannot pay back).
