Tenants and Babies rights when renting an apt?

I move into my apt on august,2008 and ever since I move my neighbors bang in the floor. I called the landlord and made a complain because we were just moving in and we were not doing anything wrong. However, this problem has gotten bigger because my 9 month old baby started to crawl and to walk in the walker. We have complained the landlord and super 3 times and I dont see no solution. Last week They started to bang the floor because my son dropped his lotion so I went to the super and he was not there so I decided to rang their bell and in a good manner I ask what was the banging all the time. This old Russian man came out cursing and would not let me talk, but all of the sudden fan old lady came out and she was close to hit me. I was holding my son and I got so scare that i went back to my apt. I called the cops they came and they completely are in my side they went down stairs to tell them that they need to stop. I also called the landlord and he said that if this problem does not stop HE WILL EVICTED both of us. How can he said that when he knows that the man downstairs had this same problem in the past. My landlord should know that this man has caused him many problems such us 3 prior tenants moving out of here. I feel stress. I pay rent every month on time. I dont get any gov help like my neighbor and more important I HAVE A BABY IN MY APT. I feel so stress. I feel like not being here, I feel threaten and I fear for my son and family life. I was also told that the family from this man is very abuse, his brother almost assaulted the prior tenant who used to live here. The super just said dont pay no mind just live your life.I cant live my life is someone is making it like hell. There is 2 police reports on this people. I have the following questions, Is there any law that protects my baby?? Is there any law that protects me from my landlord? What can I do with this neightborhs??

Ask your landlord to move you to a 1st floor apartment. People with small children should not live on upper floors.

What do you mean, "Is there a law to protect your baby?" Obviously, the neighbor cannot hit your kid, but there is no law that says just because you have a kid that you get preferential treatment. The landlord will kick you both out if you keep causing issues with eachother. I don't blame him. It's easier to just be rid of the both of you rather than take sides. This isn't a playground spat. The best thing you can do is ignore the neighbor for the rest of your lease and prepare to move when it is up. This is what happens when you live in apartments. Sometimes you get nutty neighbors who are annoying. You cannot do anything with the neighbors, they obviously didn't care about what you had to say when you knocked on their door. Moving is your best option when your lease is up. Let someone else experience living near those people.
