Toxic Mold and Rent Plus Appeal Process.?
Hello there, I have an issue I'm hoping someone who has knowledge of this can help me. I rented an apartment from Lobos Management in May, when I moved in they did not give me a copy of my lease, I called the office several times, nothing till this day, I lost my job in June made a payment in August and haven't paid Sept and Oct yet because of that fact because it seems my previous employer filed under the wrong social security number so my Unemployment is back dated and any job I've applied hasn't called back. I of course got a court summons and went to the magistrate Tuesday for the case, the Judge didn't even see the evidence I had against them for the black mold growing in the walls of our apartment which they rented to us KNOWING we had it and said they would fix and they never did. Now because of this I have called the health Department and their supposed to come and investigate. Now the question is when can they evict me before the 10 day appeal process is up? I don't think it's right to have me pay when I have physical and photo proof of the black mold as I took a sample from the stuff that's growing, as far as I'm concerned it was inhabitable...and I'm NOT the only one in that complex with really bad mold. I also live in Pennsylvania if that helps narrow down the answers...please do post anything stupid this is a real issue and needs real answers. Technically Janet I dont WANT to live there, you seem to misunderstand I want out not only that I'm not even staying in it, I have medical conditions now because of said mold, read before answering or email me personally and I'll tell you before you post and try to cut me down..:] Let me clarify this since some people can't GRASP it, I don't inhabit this apartment, I have moved out as of August FOR mold reasons I have medical conditions because of this I tried on several occasions to end this lease, so someone who actually wants to ANSWER this and actually TRY to help unlike Janet there I will greatly appreciate it.

You will never prove that you think the place is inhabitable, as you are insisting on inhabiting it. You just seem to think the landlord needs to support you because you lost your job. Wrong. He is not your daddy. You can only appeal on legal grounds, you have to prove now that the judge broke some law.

First, not all black mold is toxic, 2nd have you had the mold tested at a lab? 3rd do you have a medical report that states that your condition has direct correlation to the same mold in the apartment. Just saying it and thinking it does not make it so. You need proof, everyone that wants to get out of a lease screams toxic mold.
