Walmart civil claim against me?
After several years of shoplifting I finally got caught. It took getting caught for me to wake up and realize I had an addiction that I needed help for. I got caught stealing a DVD @ Wal-Mart. I didn't get caught by the alarms @ the door, I was caught by a really great LP team(loss prevention) Since the item was under $25 dollars and I had no record they let me walk under the terms I never enter their store again and I hand over my ''tools of the trade'' and tell me how they worked.etc I agreed, and even went ahead and bought the DVD. And have since turned over a new leaf and have been going to counseling for my problems. Today I got a notice in the mail from WalMarts law offices stating their demand to pay for damages in the amount of $175.00 And I know you are probably judging me about now. You think im a bad person and saying ''if you do the crime, you do the time'' and just think I should just pay it because they let me off easy etc. And I know, I'm not proud of the actions Ive done in the past. However I bought the DVD. There is no ''damages'' and because they didn't file charges they expect me to pay them whatever price they see fit. Im not paying it. So my question is will they come after me for $175.00 and spend all that money in trial and lawyers fee's over a 20 dollar DVD I stole? Let me know what you think regarding the legal ramifications. And if you want to tell me im a bad person and im going to hell, well feel free to express your opinion. I don't really care. I've changed, and turned from my ways. So thats what matters to me.

Unless you signed something agreeing to pay this amount, I'd tell them to get bent. Legally they suffered no loss since you paid for the DVD in question. It would be unjust enrichment.

Since you admit to stealing from them for years before you finally got caught, why don't you pay them and be done with it. Surely you stole more than the $20.00 item that you admitted to attempting to steal and which you paid for at the point of a gun. Or you could fight it and be out at least a day's pay and perhaps still be out the $175.00 as well. It's up to you. Actions do have consequences.

As you say, you have stole for years. If all it costs you is $195 ($175 + dvd) you have gotten off very inexpensively. Who cares about the "legal ramifications". If you don't pay this small restitution, you haven't really turned over a new leaf. And there are "damages", while their store management and LP team were dealing with you, what were they not "dealing" with. Was the local police also called (I know no charges were filed, it doesn't mean they weren't there), what could they be doing instead.
