Can an apartment complex still collect security deposit (or more) if they intend to remodel?

My boyfriend and I are living in an apartment; he's been here at least three years and I've been here about one year. When he moved in he paid a $300 security deposit. There is definitely some damage to the apartment; I wasn't here when he moved in so I don't know how much he did himself. But I know he's damaged the carpet, and I'm sure other normal wear-and-tear has occurred. I know the apartment complex has been doing extensive remodeling in other apartments, and I suspect that once we move out they'll remodel this apartment as well. Can they legally demand the money to fix all the damages if they intend to strip the apartment and remodel? Oh yeah...I live in Colorado, if that makes a difference :)

Of course they can. Those who damage apartments are liable for the expense of the damages they cause, regardless of any intent to 'remodel anyway'. For your reference, damaging a carpet isn't 'normal wear and tear'.
