Condo Assoc., action..do I have any rights here?
On 1/2008, my condo assoc., notified me that I was late on condo fee. I negotiated with the Assoc., to pay extra fee to caught. Agreed. Since April, 2009, I started paying extra payment. Now in 9/2009, to my surprise, I found out that the Assoc., lawyers notified via phone my Mortgage bank that there were going to put a lean on my property because of late condo fee. The mortgage bank paid the $5,000 plus to the Assoc.. Sometimes in Sept, 2009 the Mortgage Bank came back to me raising my monthly mortgage payment from 1,384 to 1,852 because the bank has to recuperate the money that they pay to the Assoc. Here, I am with an increase of mortgage payment and the bank nor the Assoc., ever notified about the above payment or arrangement. If I have known that the bank settled this condo fee debt with the Assoc., , I would have never paid the extra cash to the Assoc. I would have paid the Mortgage bank. Both the bank and the Assoc., made this arrangement without informing me. And now the bank is saying that I am failing to make my make my payments. The bank explanation is "the bank found deliquent co-op fees of $5,131.46 and this payment were disbursed from my escrow account because a tax sale would have taken place if these taxes remained unpaid. The bank informed me about this on 9/28/09. After I requested two times. But the mortgage is insured. What can I do in this situation? Pls. advise,

I would contact the property manager and get a listing of all transaction paid against your account. Make sure that they can prove to you that you are behind on your payments. If you think you are being double charged, contact your attorney immediately.

you are getting hustled. Being in the "right" won't help you. trade the condo or sell it that is absolutely the best thing you can do. welcome to condo land
