Does an employee always have an option of resignation at the time of termination?

If an employee is being terminated on the grounds that due to his/her error (the first time since his/her day of employment - being more than a year), a customer has filed a case on the company, have a right to resignation?

If the case is pending, employee may not get that option of resignation.
