Question

I have been charged by credit card bank with fraud. I made charges 90/70 days before filing. What should I do?

The judge stated that if I intended to repay the debt and had the means to do so, they cannot prove fraud. How do I do that?

How did you get before a judge without the issue being addressed already? Call the bank and try to set up payment arrangements. Contact them until you receive some type of answer. Even if they won't set up a payment plan now, you can at least say that you were trying to make arrangements. Not sure how much weight that will carry with a court since you obviously didn't do it until you found out you were being charged with fraud.

What does your bankruptcy attorney say? The credit card lender is working on the assumption that you *knew* you would be filing for bankruptcy and that if your balance owed grew during the last few months, you did so fraudulently. Your contention is that it wasn't fraud. You show that your total balance didn't grow by showing the bank statements and payments. The judge will make the decision and his decision wins.
