What will happen if my unpaid gym membership gets sent to a collection agency?

My boyfriend and I signed a one year gym contract through World Health Club in Edmonton Alberta and then I got laid off. The contract hasn't even started yet but they won't let us out of it. If we stop the automatic payments what will happen? If they send us to a collection agency what happens? How badly will this effect our credit? And, can they garnish wages or take money from tax returns? This is in Canada so take that into consideration, as Im not sure if the same rules apply as in the states. I am new to credit so I don't know how this all works. Can they take us to court or sue us or anything like that? The contract is non-transferable and non-cancellable for any reason other than death or a non-temporary injury.

Yes they can take you to court and sue you. You said yourself that the contract is non-transferable and non-cancellable for any reason other than death or a non-temporary injury. If you stop the automatic payments they will call you nonstop and send you mail to update your payment method. The collections agency will harass you, your family and friends. Next time you should look for a gym with a month to month membership contract. World Health Club is known for not letting people out of their contracts. There are tons of consumer complaints about them.

Change banks right away to keep your money where you need it. Notify the gym you have closed your bank account, and that you regret not being able to keep your end of the deal up. See what they might offer you. Im in the US. Here, there are several things that can happen, they pester you for the money, sell the debt to a collector who then pesters you. It all depends on who is handling it, some are horrible to deal with, and some, send a letter occassionally and thats it. Yes it looks bad on your credit. Oh well, what can you do. Dont sign up for frivilous things. Thank gosh it wasnt a home morgage or car loan. I would put in writing to the gym and hand deliver that you were laid off, broke, and at this time will not be making your payments as promised. Closing the bank account, in your area could be a bad thing though, Im no lawyer, but it would keep them from raking up charges from the bank. Talk to your bank and see how to either get a new accnt with them to protect your money, or close it and dont have an acct or go with another bank.....talk to the bank about this and the law to see if they have any insight. You dont want any fraud type charges added, and I have no clue if signing a contract, then closing a bank account is an added problem you dont need. But do what it takes to not rack up charges at the bank. You wont know how aggressive they are, people can garnish wages, you dont have wages now, but could in the future right?

What does your contract say? Are you allowed to terminate it at any time or do to hardship? Read the contract front and back. You may be able to get out of it (you just have to read it completely!). Yes, you are right they could send you to collections if you don't fulfill the terms of the contact. They could take you to court and get a judgment against you and your boyfriend.

Oh, it will affect your credit all right. I'd say by 100 points, but that's "ballpark figure". Hard to say until it goes to collections. There's probably a cancellation fee involved there somewhere. You'll have to read your contract. I'd talk to your local TV station that has a consumer reporter or consumer action department. They may be able to help you get out of it, even if there's technically no way to do it. Nobody wants bad publicity, right?

They will send your account to a collection agency. This will drag your score down. If the collection agency cannot get any satisfaction on this debt, they very well may sue you. Gym memberships are known for this sort of thing.
