Question
Do I still have to pay $375 realtor fee even though my financial fell through?
I signed a contract stating that I would pay a $375 transaction fee to the realtor at closing. But my financing just fell through due to strict new regulations. Will she take that money out of my earnest deposit that is in escrow? Or do I not have to pay it now that the sale fell through?

Well you owe the 375 at closing. That does not mean that you owe at another time. So if closing never occurs, no fee is due.

No if your contract states" at closing", then it isn't take unless it closes.

Read the contract and go from there. You attempted to close. So, work was performed. The purpose of that fee is to compensate for that work. If the contract says this fee is payable even if a deal falls through, then yes you have to pay it.

If it states at closing, and the closing hasn’t taken place, then no. The contract has not been fully executed. Regardless of the reason, if the closing doesn’t take place you do not owe the fee. Period.
