Has anyone heard of the sellers staying in the house after a closing?

My closing on my house is tomorrow afternoon and I was just told by my lawyer the unfortunate news that the sellers are not going to be ready to move out until 3 days after the closing which lands on a Friday. Has anyone had any experience with this? I've heard that this isn't a great situation. Any experience with this happening to you?

Seen it. Hand them a bill for $150 bucks a day and request a final walk thru before you agree to dispurse funding.

They have no right to do that but you can let them. There should be some cost to them involved.

Yes it has been known to happen. This would've been addressed in the contract under Closing And Occupancy. A request to stay x amount of days no later than x day, with compensation to you of course. Talk to your lawyer or agent and see if something cannot be worked out.

Your lawyer should draft an agreement for payment of daily rent in the amount of a nice hotel room plus mover's fee for keeping your furniture on the truck for three days. As another person said, you should inspect the property when they move out, before they receive payment for their house.

Advise your lawyer that you want the closing date moved to Friday, OR that you want $5,000 in cash escrowed by the sellers to cover any rents due and damage expenses which they may incur when they finally move out. You will not be able to do a 'final walk through' until they leave. If they damage the premises after closing, you want some security to cover same. If all goes as expected, you can refund what is left of the escrow after they move. I suspect your demand will shock the sellers in either direction, but stick to your guns. If you do not, DO understand that you become a landlord, under law, once you allow them to stay after closing. If they don't move as expected, you could face an eviction process. Good luck.
