Okay, I asked a question a while back about a harassing collection agency. Short story: I had a wreck at 16. I was in my friend's car (she was at fault for the wreck) and could not refuse an ambulance because I was a minor, and no parents to sign me out (they disowned me) Now I have a 1000 dollar bill that I was sure her insurance should have covered. I have researched some of the laws about C.As and the woman has totally broke a few: She called a third party and discussed my debt, then told me that I gave her the number that it was okay. She then called my parents and discussed my debt, and that started drama because they hate me. She is completely disrespectful to me once I mentioned this and said things such as "I am appalled that you think I am not doing my job right!" and "You are obviously not doing anything for this debt and I think we will just take it to court" and she has hung up on me and called me a liar. I totally dont think I have to pay this damn debt, and the woman has not ever stated the collection agency she works at! How am I suppose to know what to do?! I caved and called back crying and offered to pay as much as I could afford (i have no job, I just graduated from HS and I'm only 18) and she stated, snootily, it wasnt enough and that I will be in legal trouble and hung up. She says that I am irresponsible and that the debt is mine, no ifs or butts..... and she said that it has probably already been put down on my credit report.... Something doesnt sound right, I dont want to be in trouble. Please help :(

I agree with Mike! You are not responsible for that debt since you were a minor. I would definately find out if your friend had car insurance, if anything that should have paid some, if not all. Unfortunately, the CA's are notorious for harassment and YES she stepped WAAAAY out of line. You need to pull a credit report and check to see if it's on there. You can get a FREE one every year at www.freeannualcreditreport.com, if it happens to be on there DISPUTE IT. Write them and explain that you were a minor and not responsible. By law they have to investigate it within 30 days. Next time the CA calls demand to know who she is, where she is calling from and who her supervisor is. I know it may be hard but you have to be just as mean back or you will get no where. Also, you can give her my number, I will give her an ear full :) Keep your head up! And by all means don't give up! Sorry about your parents...karma is a b**ch!! :)

You can not be held legally responsible for a debt that occurred when you were 16. Your parents owe the debt. However, they can try to collect the debt from you but can't use the court system. If they try to sue you, all you have to do is appear and claim the debt was when you were a minor and it will be dismissed. Tell the collection agency to call your parents.

Did your friend have auto insurance at the time of the accident? Her insurance company would be on the hook for your bill if she did. If not, you would have to take her to small claims and sue her to get your bill paid. The collection agency person is paid to act like a b***. They know how old you are and know you are naive enough to be scared. You really shouldn't have called them back, no less, crying and offering to pay. That was wrong. Don't do that again.
