any feedback on this letter requesting a Lease termination agreement?

Dear Management for Westcreek at River Oaks Subject: Lease termination agreement My Girlfriend and I are very unhappy here at Westcreek for many reasons. Multiple problems have come up for maintenance to fix that was vital and many existed prior to move-in. Other items wrong with the apartment on the move-in sheet have not been fixed for one reason or another, like not being seen as vital to the function of the apartment. The inside courtyards are littered with peoples regular outside furniture and plaints yes; but also indoor furniture, art, trash canes, pool toys, pool items, personal grills, charcoal bags, and tin cans full of cigarette buds. The grills are a major problem as they are numerous having 14 in my court yard alone spread out on balconies, the stairs, elevator landings, and inside the pool enclosure. Pets are also a huge problem as when we first moved in people were letting them swim in the pool and I have never wanted to use that pool since. Dogs are allowed to wonder around the court yard without leashes and dog feces is commonly found on the ground or even on our 3rd level floor on the walkway from one small dog on this level. People step in it and track it up stairs and in general just let their dogs do as they will inside the courtyard. Trash bags are also a problem as people leave them in front of their door or many other locations thought the property. This is especially true on the weekends when there is no enforcement and people can get away with it. OMG bugs are also a big problem. We have had you treat it once and they have returned. Ants come in the bathroom when it rains and we swear we can hear mice in the space above the ceiling but maintenance said nothing could be done. Everything I have mentioned above I have talked with the leasing office or maintenance about without getting a satisfactory answer and I have photographic documentation of many of the issues around the property. I would like to come to an arraignment that is between just us and see if this can be resolved without any hardship, liable emails, or other actions. I would like to provide a 60day notice to move as soon as possible and receive from you a lease termination agreement in writing with terms we can both agree are fair to both of us. Although your letter is lengthy and you say you are "unhappy", it would not convince me to let you break your lease. Did you not thoroughly check out the grounds of your apartments before you signed your lease? If so, you would have known what kind of neighbors you were going to be living around. So, I do not think that this should be the majority of your letter. You should really focus on the maintenance issues, the rodents, and the UNSAFE living conditions. You really need to list the problems they have not fixed and show how they are affecting your health. You can EASILY show a connection between bacteria/disease and the roaches, ants, and rodents. As for the maintenance issues, you don't say what they are, so I can't give you any ideas. At the end of the letter, you need to be more direct. You should say: As a result of the complaints listed above, I would like to pursue the necessary action to terminate my lease without any penalty. Please contact me immediately to discuss my request and to begin the processs to end my lease. PS There are quite a few of spelling mistakes and casual language in your letter. This needs to be very formal, without spelling mistakes in order for you to be taken seriously.

You are wasting your time. None of what is listed in your diatribe is grounds for a lease termination. You are far better off to address the issues mentioned a few at a time, in hopes of correction. Meanwhile, be prepared to pay whatever the complex demands if you leave your lease before expiration.

It is not April 1st so I gather you are serious. Not going to happen. You signed a lease, a legal binding contract that the corporation will not allow you to break. You will be sued, eviction place on your credit report and hounded for the remaining rent due on your lease

I see nothing there that validates a lease termination. The move in sheet is a inventory of things you feel are wrong in the apartment so you won't be charged for them when you move out.This is not a request for repairs and what is on that sheet will not be fixed or repaired unless you put in a written service request. You can terminate but you will be responsible for termination fees and any and all lost rent until the unit is leased again. Talking about this and that means nothing.You have to put it in writing.We pay no attention to anything that is verbally told to us.It is either put in writing or we ignore it. You won't get out of your lease and there is not arrangement to be made.You are at fault and hopefully they will see to it that you pay what you owe or it goes to your credit report and stops you from doing this to anyone else.
