Is this possible (first time home buyer)?
My friend and I are in a disagreement about the First time home buyers credit. She and I both purchased our first homes around the same time. My husband and I signed our papers on Jan 22, 2009...her husband and her signed on Jan 26, 2009. We both received the tax credit in February. She is now saying she is going to claim the 8,000 this year since she got 7500 last year, I told her she gets 1 shot and not both. But she disagrees and says since she has to pay back the 7500, the 8000 is a totally different thing. I understand they are different but cant you only claim one and not both? I didnt say we got the 7500, my husband and I got 8,000. She said when she filed her taxes online the 8,000 wasnt available yet and she got the 7500

Well, for the 2008 home buyer credit, you had to have purchased by Dec. 31, 2008 -- so, I'm not sure how you both claimed it. You both qualify for the 2009 home buyer credit since you purchased after January 1, 2009, but you're right, you can't claim both credits. You've already claimed a credit, so you're out of luck. She may be able to prove that there was a mistake and pay the $7,500 back, and then claim the $8,000 credit; however, she'd then only have $500 in pocket -- so, she'd have to decide if it's legal to do that, and if it's worth it. They aren't going to let you claim two credits on the same address for the first-time home buyers... which is what she's trying to do.
