eBay I'm already registered as a business, Ligal scam loo poll?

I am a registered business in the UK I pay TAX and VAT and I declare that I am a business in all my listings and provide contact information. so ligaly i dont have to register as a business with ebay, is that true? eBay scam quote "The Unfair Commercial Practices Directive (April 2008) makes it an offence in the UK for a business to falsely represent itself as a private individual. So if you are misleading potential buyers into thinking that you are a private individual when you are in fact a business seller (ie: by not registering as a business seller with eBay), you will be breaking the law." now if you leve the ()'s pat out it reads "So if you are misleading potential buyers into thinking that you are a private individual when you are in fact a business seller you will be breaking the law." << that eveyone knows but ebay have constucted it like this, watch if i take out the ()'s. "by not registering as a business seller with eBay, you will be breaking the law."" << this is false In all the information they provide they never state that it's law that I have to tell them I'm a business they only state that I have to declare im a business to the customer (which I can do myself in the listing) and that i ned to register TAX and VAT... what does that have to do with me tellign them I'm a business so they can charge me more!!!? What do you think?... Anyone?

Yes it is against UK/EU Law not to register yourself as a Business on ebay (as you obviously are) You must also have your Business address on each listing or on your ME page. This is to give Buyers their rights to your address before entering into a Distance Selling contract with you. You must also comply with a correct returns procedure, and allow Buyers the right to return an item with no reason given whatsoever. This is their rights under the DSR (Distance Selling Regulations) And yes at the end of the day ebay will get a bigger slice of your profits; so no more free 99p listings eh! It's their Venue, their Rules, You either comply or will be kicked off

Are you saying that you don't want to register w/Ebay as a reg. business entity (Sole Proprietor - LLC, etc) because they'll charge you more to list your items or ask for more in fees then if you were just a private citizen, selling stuff from their home/garage? I wouldn't take the chance - I'd just charge a little more to make up the difference. Getting kicked off Ebay is pretty bad.
