took a deposit, didnt register it, issued a section 21 as not paid for 4 months. can we still go to court?

this person has been given ample chance to pay. even done a payment plan for arrears. she then signed a document knowing that we would put in to force the section 21 she signed if she did not keep to her plan. We have been told that if we did not register the bond then the section 21 is void ??? that is a first can anyone clarify

Correct. You have to evict under a section 11 if you didn't register the deposit. You may also be liable to pay compensation of 3 times the amount of the deposit

If you didn't register the deposit then she is legally entitled to sue you for 3x the original deposit amount. Sadly, if you failed to register the deposit you cannot legally serve a section 21 notice.

She may not be as silly as you think. If you did not register her deposit and go to court, the judge could award her 3x the deposit ! Get the deposit registered NOW, then serve her a sec 21 and a sec 8 for non payment of rent. She has to be 8 weeks in arrears.
