I have a full time job and part time Realtor. If laid off, being a realtor would affect my unemployment claim?

I have been working for the same company for almost 12 years. It is almost 100% sure I will be lay off within the next 4 months (my company was bought out). I've been doing real estate for the last 5 years, but due to the real estate market, I have not close a deal in almost 2 years. Does anybody know, if being a Realtor would affect my unemployment claim? and if it does, in what way?.... and lastly, what can I do to prevent from this to happened? (What is the policy of the Department of Labor on this?) Thanks!

In Illinois ( I am certain it is similar in other states ) you have to phone in to certify before you receive an unemployment check every two weeks. when you phone in, a computer asks you what your gross earnings were that week. The weeks that you received a commission, you would have to enter that amount in as gross earnings. On the weeks you didn't receive a commission you would enter $0 for gross earnings. On the weeks you had a commission you would not get an unemployment check, but the weeks that you did not have a commission you would get an unemployment check.

if your still working as a agent the dept of labor will consider that self employment. if you get paid even on a 1099 it will affect it to prevent it when you get laid off stop working as a realtor if you do want to work it just do weekends so it wont affect your claim. lastly start looking for a job i have been out of work 5 months and I look and interview all the time not so easy like it was 12yrs ago , i have 20yrs work experience and a college degree in business

Since you didn't have a deal close in 2008 or 2009, it shouldn't affect your unemployment. While on UI, you notify the state of any money you earned during the week. Depending on how much you earned, it could have no affect, you could get a reduced amount, or no UI for the week.

If you have not closed a deal in two years, that's not even a job. You are not receiving any income from it. The job you are about to get laid off from is the only income you have from the sounds of it. You should be fine for unemployment. Good luck
