My roommate wont let me take my name off the lease?
We got into a big argument and she went to the leasing office to take her name off the lease but found out she didn't have the income to stay and they didn't rerun my credit and assumed I couldn't stay either. After talking with the leasing office, our 6 month period is coming up, giving her enough time to get a job or me to build my credit and one of us leaves and we can either transfer or stay. I decided to be the one to leave the community and started looking for a new place to live. I applied at another apartment complex and was approved. I yet still have to sign that lease. Anywho- she got a job, minimum wage but she also gets state grants, scholarships, and has a student loan. That gives me the perfect opportunity to sign off now. I was letting her know that my move out date if I would sign this lease is the same day of the 6th month period and I will continue to pay the next 2 months. She said I can’t leave. She doesn’t have enough money to pay for a transfer fee of $300 and wants ME to pay it. Little does she know, I have to pay a $400 medical bill because I recently had a CAT Scan. I said I could help but no, she wants me to pay it all. I told her that I wasn’t going to do that and she said “Then I wont let you off the lease.” I still can get off the lease; she can financially support herself, correct? Why should I need her approval to have my name off? I don’t even know why she wants to transfer to a 1 bedroom because that $300 is almost 1 months rent. I went ahead and typed up a letter to the leasing office and let them know the exact date I want my name off the lease and my stuff will be out the same day. I have a feeling she doesn’t want to provide her income information. Couldn’t this become a illegal matter? If she’s qualified why should I stay? It's a 12 month lease, but at the 6 month period, there's the option that my roommate transfers to a 1 bedroom for the remainder of the lease and I signed off of it. That was the orginal agreement, but she's now refusing to do anything and try and keep me on the lease even though she can afford the place on her own. I'm so confused and fustrated..

A lease is a legally binding agreement and nobody HAS to let you out of it! Most of what you posted is completly immaterial. Your releationship or lack there of with this roommate has nothing to do with the lease. It also does not legally matter if she can afford it on her own. If the roommate & the landlord do not sign something realeasing you from the lease you are NOT getting out. PERIOD!

I believe the lease is up to the lessor, if they will accept your removal from the lease, it is their decision, not hers since you are making the change, the transfer fee does seem to be your responsibility

If you both signed the lease then the landlord is the only one that can take you off early. In most cases they won't do it since it is in their best interest to have two people on the hook for rent than one. Once the lease expires she has no choice about getting the lease in just her name. There is no law that can make you resign a new lease with her.

When your lease is up, your lease is up when you give the lease office your notice of vacating . Unless you have already signed a contract to renew your lease, which is not the case, you should not have any more obligations to your contract. You've submitted your notice of your leave date on paper. That's it, you should have no other obligations besides not destroying the property and leaving it somewhat cleaned up when you turn in your keys. And you definitely have no other obligations to your soon to be ex-roommate. If anything, if you allow her to keep using you for paperwork, she will most likely make a mess out of your history, so I suggest you get out of that relationship as soon as you can. Good luck.
