Can a company refuse to pay an hourly + commission worker overtime? I live in Houston, Texas?

I work and live in the state of Texas, the company i work for pays us from 10 to 14 dollars an hour plus commission, but over 40 hours they are refusing to pay time and half, is something like this legal, or are they breaking the law. thanks.

you are either exempt or non exempt employee. if you are exempt they do not have to pay overtime. most hourly workers are non exempt so this seems odd. you need to verify that your employer is classifying you properly under the Fair Labor Standards Act and your state laws.
