Question
Do you have to be a US resident in order to form a nonprofit 501 3 corporation in the US?
I am an American citizen but I dont live in America, haven't for almost 5 years. I have an organization here in Europe that I would like to establish in America.

There are neither citizenship nor residency requirements to form or operate a 501(c)3 corporation or any other form of business operation. You have not provided any detail of your operations but I assume you already have an idea that your business purposes satisfies 501(c)3 requirements. Many self help books are available on formation and requirements for 501(c)3 Corporations in larger book venues like Barnes & Noble. Borders and Amazon. I like those published by NOLO PRESS.
