Do I qualify for personal injury protection?
I was a passenger in a single car accident. There were three of us. Myself and the supposed driver were knocked out of conscience during the impact. The owner of the car walked away. The owner currently has a broad form of insurance on his license. The driver had no insurance. I am going to be receiving large medical bills as I was hauled away in an ambulance and put through cat scans and what not in the trauma center. One lawyer office said there is no hope for getting my medical expenses covered...... does anyone know if this is true? I am in Washington State. I did the Greg Swapp "One Call That's All". They informed me that the owner's broad form insurance covers him only as an individual and since the driver had no insurance that I have to eat it. I would think that I would be covered under the owners insurance yet these guys are telling me i am not..... is this true?

Homeowners insurance never, ever, ever covers auto injuries. Ever. If the guy you were riding with had no pip coverage, then you need to go to YOUR auto policy, and file the claim under YOUR pip coverage. If you're a minor, under your parents' auto policy. If you have no auto policy, then no one has any insurance in place to cover you - you'll have to actually SUE the driver of the car you were in, to recover any money. WA state does NOT require autos to carry insurance. If the driver was uninsured, then there's no coverage. Sue the driver.

"Supposed driver"? Either he drove or he didn't. Either way, the owner of the car "supposedly" allowed the guy to drive, so it's his insurance that's responsible for damages. IF they don't find a loophole to weasel out of it (like the "one law office" appears to be thinking).

I did a search for PIP and per my google search shows that Washington State does not require PIP. Your options; Does owner of car have insurance? Driver of the car, not owner of car have insurance? Do you own a car or does your parents own a car and you are covered under that policy? Do you have health insurance? If the answer to all of the above are no, then you will get ZERO. Since you have hired a lawyer, he has obviously checked out all your options and has come to the same conclusion. I heard it all the time while handling injury claims. The injured person complains that the policyholder did not have insurance, but when I asked them if they had insurance, they stated no. It's like, I am not suppose to be responsible to have insurance JUST IN CASE I might need it and then be surprised when others feel the same way and expect them to pay. Your only hope is to sue him. But most likely will get a judgment, but if he has nothing, you cant get anything from nothing. good luck
