Question

My father co-owns property with a sibling who died a year ago.?

More than 20 years ago my father inherited a house in Washington, D.C. He co-inherited it with his sister. His sister, who lived in the area, decided to move into the house since my father lived out of state. Over the years my mother begged my father to sell the house to pay college costs for myself and my siblings. My father, who probably felt guilty about selling the house which his sister was living in, declined. For a period of 22 years or more my aunt, her husband and their children have lived in the house. Over a year ago my aunt died and my father began discussing with me his interest in once and for all resolving the issue of the house. Now, my cousin has moved back into the house presumably to take care of her father. I feel that this is a nightmare situation that is never going to end. My father is 75 and he deserves after almost 25 years to sell his property. My uncle by marriage has benefited for over 22 years of not having to pay rent. Please tell me what you think. Also, in that they lived there scott free for 22 years is it even an equitable split? Shouldn't my father get the lion's share of the property?

What agreement did your father & aunt have regarding the disposition of the property? What about the aunt's will? Did she leave her share of the house to your father, or does he now co-own it with her spouse and/or children? Read the documents and follow up, or else get an attorney and have an attorney negotiate for aunt's heirs to buy out your father's interest.
