How do I legal get someone to act on my behalf if I am the landlord & living in a different state? I currently rented my house in Texas with a legal rental agreement. I have taken the legal measure of evicting the person, and the court is in August. The reason I was renting out my house was because I moved with my job to Indiana. How do I legally have my daughter who still lives in Texas represent me on my behalf with the rental house, court dates, and any other issues that may come up since I live in another state? I would also like her to be able to go into house to do inspections, and be able to show the house to new interested parties.

She can go to court for you, ignore those who state otherwise. You can not legally pay her any money, but she can act as your agent. You need to inform your tenant in writing. Spouses, children and parents can all represent their family member in RE cases. But whatever you sign is just as if he signed it.

The easiest way to do this is to sign a Power of Attorney naming your daughter as your representative. You can find these forms at Office Max or Staples.

Call the court. You may be able to get by with granting power of attorney to your daughter. No problem with the other stuff.

...you must give her "Power of Attorney". (you can draft up the document with the help of most Para-legals...or an Attorney).

Go to a lawyer and get her a power of attorney specifically listing those things you want her to do for you.

unless your daughter is a licensed RE agent or attorney your daughter can only sign documents for you, she cannot evict for you. you can solve this easily by hiring a TX RE atty or hiring a prop mgt firm. The atty is your best bet though more expensive in the short run. available to guide you further
