Is it legal to count a disabled young adult on your taxes?

I'm disabled but not on SSI, have no income despite being 25, on/off again student, is it okay for my parents to claim me on their taxes. I mean I am still depending on them.

A parent can claim a disabled child under the Qualifying Child rule indefinitely. If you live in your parents' home for more than half of the year, your income is irrelevant as long as you do not provide more than half of your OWN support. The income limit mentioned by Helen would only apply if you did not live in their home. In that case your income (excluding non-taxable Social Security income) would have to be less than the personal exemption amount and they would have to provide more than half of your support.

As long as your taxable income is less then the personal exemption (and your SSI does not count), your parents can continue to claim you. This assumes you do not provide 50% of your support. Helen, EA in PA
