Vendor refuses to remove machine from my office while I dispute our contract. Help!?
I work at an office, and we contract our coffee service out through a vendor. Our machine broke last week, and despite that I called for three days to get them to come out and fix it, they just send a technician out yesterday. It broke again this morning. The terms and condition of my contract with them says that I can terminate the contract if I feel the vendor has not performed or has unsatisfactorily performed the contract. When I told them I wanted to terminate my contract based on this condition, and that I'd like our coffee machine to be picked up, they refused. They said our account will just go to collections, but they would not take the machine. What should I do? Isn't this against the law somehow? Are they just trying to skirt the issue? Thank you!

Why are you arguing on the phone? If your contract really states this, send them a written notice of termination citing the applicable section of the contract. Sounds more like you have a disagreement in interpreting the terms of the contract.

Is it free or do you pay monthly for it? If it is free, just move it to a corner somewhere and replace it yourself. If a monthly fee, stop paying, but advise them in writing about the termination clause that you are invoking and keep all documentation in case they do turn you over for collection.

You'll have to go to court while you dispute the contract. Do not remove the machine yourself or let anyone go near it. Take pictures and tape it off.
