Question

Haven't received my W2 form... How late can I send it out?

Its July and Ive been working at a job since may that I also worked at last summer. I told my boss I have not received my w2 from last year and he has been putting it off for about a month telling me that he has called and it should be sent out soon. I am going to fill out a 4852 form for the IRS but I wanted to know when is the latest I can send a W2 for last year? Thanks!

Employers are required to, under normal circumstances, send employee copy of the W-2 by January 31 after the year-end. So for 2008 tax year, W-2s were due Feburary 2, 2009 (January 31 was a Saturday). If you'd expect to have refunds, then you are okay; but if you'd expect to have a balance due, then you may have penalty and interest assessed every day your return is not filed.

Any W2 for last year should have been postmarked by January 1, 2009. The laws call for the employers to have them sent out to the employee by that date.

Um, you might want to call the IRS because the deadline for filing your taxes was April 15th and you can get lots of fines for that, you might also want to notify them that it's your bosses fault.

I assume you mean "file my tax return" when you wrote "send a W-2." You have three years to file a return to claim a refund. If you owe, then the longer you wait the more in interest and penalty you will pay. You can call the IRS for a transcript of the W-2. They should have it on file.
