Question

I would like to kick my roommate out because of her bad behavior, how do I do this if she's on the lease?

It's a long story so if you're bored you're in the right place. My roommate has been nothing but trouble for the past several months we've been living together. It first started off with me, her, and her boyfriend living together in a townhouse. She was drinking ever day of the week non-stop and she was unemployed. She also admitted to me about going to men's house and using them for pleasure. She also admits to smoking weed and said she had no plans to do it again. The boyfriend was so fed up that he broke up with her and said we needed to new place to live. He was planning to move anyways to the North side of the city closer to work. The lease was ending in June. I had already started working on getting a lease with a apartment complex down the street for myself but I started to feel bad for her. So I went ahead and got a 2 bedroom apartment and told her she can move in with me and told her that she must put some more motivation in finding a job. She got a job at a tanning salon. Things seems to be going good for awhile. I was very pleased with the outcome of getting approved for the lease and her getting a job. A few days before we moved in, June 7th- she went out with her friend to go drinking on a Friday night. I was already having a bad night as it was-I was being dragged into the middle of family drama. Without any concern she left with this girl that we all knew had some jealousy issues. I can't tell you the entire story behind why they got in a fight, but on their way back home from drinking they got into an argument and started to fight in the car. The friend called the police and my roommate was arrested and held for 24 hours. I was able to pull of the police report and it said that my roommate wanted to be dropped off at a male residency. While the friend was talking to the police my roommate got out of the car and started to yell at the friend and the police. They arrested her and she was charged with Battery and Public Intoxication. Sunday morning came around and when I found out she was arrested I was speechless. She was fired from her job for no show, no call. We got the keys to the apartment and both agreed that she needs to learn to be a better person. The next two weeks or so we were doing pretty good- watching movies and hanging out when I got home from work. Suddenly she meets the neighbors and before I know it she was back to the same person before. She’s been spending almost every night there and her behavior changed dramatically. At first I was glad to make some new friends but then when I found out they were into Weed, I decided not to get to close to them. My oldest brother is very protective and he is also a police officer. My roommate however overlooked the consequences of hanging with these neighbors and the past few weeks have been edgy. One of her friends got her a job as a server that she only went to maybe three or four times. On her way back home she got hit by a drunk, unlicensed, uninsured driver. She can’t afford to get a new car. Her grandfather bought her a bike but she says it too dangerous to ride her bike to work even though there is a bike trail. So instead of going to this job her friend kindly got her, she’s been next door and I already assumed she was sleeping with at least one of them when I saw that he had hickies all over his neck. Then a few days later she stumbled in repeating her words, slurring, and forgetting what she was going to say. Her eyes were dilated and bloodshot and she reeked with a horrible smell. I have never smelled Weed before but I knew it wasn’t just normal cigarettes. Yesterday I came home and one of the neighbor’s friends was in her room and they kept leaving and coming back. Leaving and coming back. Then the neighbor showed up and they carried a bag with a towel over it and my roommate made the neighbor carry it out. They left so I called my brother and asked him to come visit when he gets off duty. He said okay. I also noticed her status on Facebook said “possibly a good night rotation,” I had no clue what that meant. I was going to assume it had to do with weed. When my brother came over we waited for her to come home so he can tell me what thinks and she didn’t come home. When he decided to leave, I told him to take the patio door because it’s closer to the parking lot. He said he walked by the neighbor’s house 2 doors down and she was getting out a car with someone else and when they saw him, (in uniform) they ran into the neighbor’s apartment and flipped off the lights. He was like “Okay weird,” and called me when he got in his car and told me just happened and I was like “Weird…” Lately she’s just been a horrible roommate. She leaves the lights on, she leaves her hair straightened on and leaves the apartment. She’s not working and I can’t prove if she’s smoking weed- but still its painful to suspect it. She’s on the lease and I just want her out. If you made it to this last sentence congrats….but How do I go

Find the language in the lease agreement she is in violation of. Issue her a letter to quit the behavior in 7 days or "quit the lease." This must be done in order to get a court involved later. If she does not stop the behavior then you may start eviction proceedings with the court in 7 days.

If you are both listed as tenants on the lease, you cannot legally kick her out. She has as much right as you do to remain in the rental until the lease expires. You cannot issue her a Lease Violation Notice or Notice to Cure or Quit, only the landlord can. You cannot terminate her from the lease or evict her, you do not have that right.
