Is there any chance to get my employer to pay my tax and NIC?

My employer hasn't given me P60 in 3 consecutive years even though I have asked for it many times. To make matters worse National Insurance Info-line says they hold no information about my current employment. I have also told that to my employer but he seems to just ignore me all the time. To make matters even worse he not only refuses to give P60 he doesn't provide me with payslips either. I am willing to leave the employer at the nearest possible occasion but fear that if I don't solve this matter now I will never be able to do so. I am a foreign national(EU) and I'm planning to leave UK soon. I have always been very careful about employers and since I've been employed by an accountancy office and was told on many different occasions that I didn't need any payslips nor p60 I treated it as true plus the fact that it is an accountancy office makes me think they should abide the tax law so I did not make a big tickle about it. I see now that I was wrong and there's something dodgy about my company. However, it does not change the fact that I have no proof of employment, no payslips, no p60, no information held by National Insurance number. The only thing I could prove is regular payments made by my employer into my account by the means of cheques. The fact is that I have been employed and all I want is to have clarity on matters of NI Contributions and Tax. I do not plan to take any benefits I just want to leave the country with peace of mind. What would you do in my case?I am running out of ideas and the fact that my employer is "smart" does not make it any easier. Could somebody help me? I didn't rise the issue with my other colleagues at work as I don't want to make a big hassle about it before I am clear on what I need to do.

Jobcentre can't do much about this. Contact your nearest Tax Enquiry Centre. You may have to make an appointment to go to see them. Keep photocopies of any cheques given to you by employer. You haven't got anything else as documentary evidence, proof of employment. If you have paid previous cheques in yourself, there will be nothing to identify them now on your bank statement. Your employer isn't fulfilling his legal obligations. Just report him to HMRC. Don't tell him you have done so, HMRC won't tell on you. If HMRC find against employer, they will make an enquiry into his tax affairs. He will be liable for any tax and National Insurance he has/should have deducted from you, plus penalties. You will not be told of outcome by HMRC, due to the Official Secrets and Data Protection Acts, but any liability you have will be satisfied. The chances are that if employer is treating you like this, he is doing the same to other employees, and HMRC will be very interested. HMRC may need you to complete forms P86 and (when you leave the UK) form P85. Those forms are for people coming into and leaving the UK. They establish your residency, and if you are entitled to British Tax Allowances. you can download from www ... , then put form numbers in search box.

Your employer should definitely be giving you payslips and a P60 - it is a legal requirement for them to do so. You must contact the HMRC (old inland revenue) asap and ask for advice - you might even be able to get advice off their web pages, they are very thorough - easy to find through a search engine - just type in HMRC or inland revenue. Good Luck and find a new job asap.

Your Employer is disgrace, and I apologise to you for him. You could make an appointment at your nearest Job centre, have a chat to them, tell them what you have said here, and they will help you in the way that you need. Do not be afraid, and do not tell anyone at work, anything you say at the Job centre will be held in confidence, and they will know how to deal with the matter.
