Question

Can I refuse to speak to my finance company on the phone?

I am in a dispute with my car finance company (local business) over late fees that I do not owe nor does their contract state there are any and the woman from their company is an irrate person who is so far from professional that I'd rather have a full blown conversation with my dog at this point. She has targeted in on me because I don't put up with her crap and I want to know if I can just simply refuse to speak to her on the phone. Any corrospondence I have make with their company has now been in writing and I document everything. At this point I am up to date on payments other than the so called late fee she claims I owe which I am attempting to dispute. Is there a law that states I have to speak to them when they call? I am in Florida

you do not have to speak with them...exspecially if they are abusive...write them to let them know that you will only do it through the mail...if it is a company like household finance..they can be scum of the earth...

There is no law as such... but what will happen is they will forward this bill on to a collection management company. Once there, it will be extremely hard to dispute the charge without speaking to a lawyer and possibly going to court. The collection management company can lower your credit rating, call you at all hours at home and at work, and generally harass you until you pay an even larger fee, as you will then be paying the collection management company as well. If it is a lot of money, talk to a lawyer. If not, I'd say cut your losses and pay them, and then just don't do business with them again. Write in to the Better Business Bureau about them if you feel they have seriously wronged you. That may pay off instead of waiting around for your credit to get trashed because you didn't want to speak with them.

you will be best served speaking with her no matter how painful. Your best chance of getting these fees waived is by this lady. Next time politely ask her to send you the portion of the credit agreement you signed which spells out the late fees.

Um yeah, Just call the home office. They have to have a bank through which the loan are done through. find out who this is or see if it is possible to refinance your car loan.

Of course you don't. Just communicate in writing and tell them to do likewise.
