i was just served papers by the sheriff, being sued for credit card debt?
since i have nothing of worth in my name, and my work is so sporadic that i can barely keep up with utility bills and rent should i just let it go to court and have it put on my credit report along with other judgements and old debts that are already there. my wife brings home 100 bucks a week after paying our health ins. and i havn't had a job in a month. i have a few antique well drillers and the past 2 years i've only had an average of 1 well a month to do, scraping by just barely

You should check the collecting statute of limitations (SOL) for your state. If the debt is SOL then you should include an Affirmative Defense of SOL in with your answer. Just because you are judgment proof right now, doesn't mean you will be in the future. Judgment SOL can run for a long period of time, and can possibly be renewed. How long and whether they can renew or not depends on your state. If they do get a judgment against you, whether it is a default judgment or not, they can sit and wait until you have a regular job, if your state allows wage garnishment. Like someone already mentioned, they may be able to seize your bank accounts once they get a judgment. Answer the judgment and show up for the hearing. If nothing else, you may be able to better protect your assets if they do end up with a judgment. If the debt is SOL then by answering with the affirmative defense and showing up will probably result in their losing the case. If you don't show up for the court date, the creditor gets a default judgment against you.

The court won't be able to make you pay what you don't have. Your creditors could get an order to attach your bank accounts if all else fails though. Good luck.

If you just let it go, you lose by default, and if you ever DO have assets or income they'll be subject to being siezed or garnished, it doesn't just go on your credit report. But if the debts are legit and you haven't paid them, then even if you do go to court you'll lose anyway, so the result will be the same.
