What do to if an Escrow company stole your money?

My father sold his business last year and received services from an escrow company. When it was time to transfer the money, he only received part of it from them. They claimed that there was a judgment on my father regarding a previous lawsuit. We got a lawyer and went to court to remove the lien from that remainder of the money and got a judgment in our favor. When my dad went to the escrow company again, they gave him all these excuses as to why "they still couldn't release the money" to him. They said they had to contact our lawyer which they never did. We have tried numerous times to reach them and have been unsuccessful. We find out that that "escrow" company is being investigated by the California Department of Corporations for fraud and for failure to release audit records. And that their employees have had their licenses suspended before. I have since sent a complaint letter to the Department of Corporations along with numerous other sources. My questions is what are the chances of my father getting his money back if his company failed to pay the fine the Department of Corporations imposed on them? Our lawyer says that we should wait for the investigations of the Department Of Corporations to be over before we due a suit. Need help as I am very frustrated.

Sounds like he may not get his money back. Mainly because they probably owe everyone else! I find it odd that your father was sent to try to collect the money. Why were you paying a lawyer? He should have been the one to get your money for you. I agree that you may want to wait until the investigation is over concerning this place, because if they are found to be in the wrong, it strengthens your case. Problem is, they may go out of business or file bankruptcy before the suit is over.

Escrow companies normally will pay any lawsuits, collections and all other liens against the property in time of a sale. They do have to let the seller knows about what money is paid and to whom. so I don't understand how they could do that without your dads authorization. You need to talk to them again and if needs talk to a lawyer.
