Are employers in some states required to have disability insurance?
Some states such as New York have disability insurance which is intended to Absence from work due to pregnancy and childbirth is covered 6 to 8 weeks of paid leave immediately prior to or after birth (longer if complications occur). However, are employers such in the State of New York, REQUIRED by law to have the insurance or is it optional? And yes I know that companies must provide Workman's comp but I am interested in the extent to which employers are obligated to provide maternity benefits outside of the FMLA. Thanks

The requirements vary by state. They also can vary by the number of employees there are in the business. That is a small business may not be required to have disability coverage but a business with a lot of employees might be required to have it.

Employers are required to provide short term disability for their full time employees, in NY, CA, and HI. Maybe more states, those are the ones I can think of off the top of my head. But that disability coverage is NOT required to pay for maternity leave. Childbirth is NORMAL. Not a disability, not an illness.
