Question
How can I hand out flyers for my band without it being considered soliciting?
I was going to go to the mall this weekend with one of my bandmates and some members of our street team to hand out flyers for an upcoming show at a local venue and to try and drum up some new fans. We were going to include a link on it for a free download that's being offered online through Microsoft, so not only is it just a free flyer with info, we're actually giving things away for free, we're not trying to sell anything. I thought of the idea because I got to chatting up a Hot Topic employee in another mall about my band and he said he'd be glad to keep some flyers there for us for customers to take. However, I just thought of the soliciting aspect of it. I don't want to cause any trouble and I certainly wouldn't force our flyers on anyone. In fact, we were thinking of making t-shirts saying "Ask me about my band" so that people would come to us (you'd be surprise how well that stuff works!) so it wouldn't count as soliciting. I tried e-mailing the mall to ask and haven't heard back yet, so I'd like to ask for your opinions. Please give me any guidance you can because I'd love to be able to spread the word about my band without getting in trouble! To thank you in advance for your insights, here's the link for the free song online, it's the least I can do for your assistance! Thanks again! www ...

The worst that will happen is security will tell you to stop - Go ahead and do what you can unless or until you are told to stop.
