Question
Can I smoke in my apartment(PA)?
I just moved into an apartment in Pennsylvania. And I don't know exactly that if I can smoke in my apartment. There is a smoke detector in my room, but I got a window fan so I think I can smoke near my window and let the fans exhaust the smoke. Is it legal to smoke in an apartment in PA?

If your lease does not specify that there is no smoking it is perfectly OK. The detector will not go off from cigarette smoke, it is there by law, in case of fire.

You need to ask your landlord or check your rental agreement and lease.

Since being a smoker is not a protective class, landlords are free to discriminate against smokers, so read your lease

There is no PA laws that say you can't smoke in your apartment. A landlord can make his/her rentals non-smoking, but that would have been mentioned when you looked at the apartment if it were important enough to the landlord. You might check your lease to make sure there is no clause saying it is a smoke free apartment. The smoke detector is there because they are required by PA law.
