Question

Collection agency garnishing my wages?

My employer received a subpoena to garnish my wages on a medical bill ($584) I screwed up and forgot to pay. I' not sure (and neither is my employer) on what to do now? I certainly cannot afford to pay it in full (can't get blood from a turnip), but I'm afraid this collection agency is going to go buck wild and completely screw up my living expenses. I've dealt with this debt collector before, and frankly he 's a twisted devils child. Has anyone had any experience with this? What steps do I take now? Thanks! No offense, but how could anyone take seriously a person that named themselves "Toothless crackwhore"?

No one can garnish your wages unless they have sued you in court and won judgment. Have you got a judgment against you on your credit report?

Apparently the company previously got a judgment (may have been a default judgment if you ignored a summons) and they are collecting information from your employer to garnish your wages. They could also possibly collecting information from your bank to garnish your accounts. Once they have that information, they then get a garnishment order. When they get the order, they will send the garnishment order to your employer and/or bank and they must follow the order by law garnishing your wages and/or account. It sounds like your employer got the subponea to collect information about your wages. He must return that information to the court. Most states allow 10%-25% of your wages to be garnished until the debt is paid.

Well the only thing that you can do at this point is to contact the debtor and see if you can work something out. I had got served papers to appear in court for a credit card bill and I ignored them and didn't show up, well a few months later they garnished my wages. They took 10% of my pay and I had to tell them that I was the head of the household, if not then they would have taken 25% of my pay per week. Instead of that bill being $584 it will end up almost $1,000 after they tack on their fees. Those garnishments are painful because they deduct every pay period for six months and then stop for a month if you haven't paid them off then they will start the garnishment process all over again and will tack on ridiculous interest for the remaining balance its a vicious cycle! Good Luck!
