my landlord has placed a dumpster in our driveway... is that legal?
our landlord owns the house next door and is doing repairs on it and places a HUGE dumpster in our driveway greatly inconveniencing us, is this legal? we live in new jersey if that makes a difference. she will yell at us if we park on the lawn, we always pay rent on time, and shes not very reasonable and we've talked to her and expressed how inconvenient it is, she doesn't care.

Does he know you are being inconvenienced? How long is it going to be there? Just talk to him. He's just trying to take care of his property.

Have you talked to him, maybe he's just a clueless SOB? If he doesn't respond the way you want I'd send a Certified Letter to him demanding the removal or you will start charging him driveway rental. I'd give a quote of $50 per week.

Call your municipality's Building Code Enforcement Officer and ask what the town laws are governing the placement of a dumpster. In Fort Lee it had to be in the driveway of the house undergoing renovation.

You can approach it from a technicality. Most cities require rental units to have off-street parking. If this dumpster is taking up your required driveway then the house is violating city code. Putting a dumpster in the driveway is not a violation in its own right, but taking about required parking is. Call you local zoning code enforcement officer at city hall and talk to them about the issue. If they don't require parking you may be out of luck.

Given your additional details, your question becomes a moot point. She obviously does not care one iota about the convenience of her renters. It's her property. She can do pretty much what she pleases. I wouldn't re-up the lease with her when it comes time to sign. This is why I always loved complexes when I was young and had to rent. There were rules instead of personalities.
