How can my father get out of his apartment contract? the complex won't repair anything...?

He's in an apartment contract until october, he;s been having problems and been complaining, yet the office won't order anyone to repair anything. there's a stench coming out of the drains in the bathroom, exhaust in bathroom is broken... he thinks there someone from the county building that can help him to break the remaining contract....im confused & dont know what to even look for. oops! We're in Indiana. They're trying to tell him that the exhaust is fine, but they're trying to play it off because he's chinese and they think he doesn't know anything about repairs. he told them off but he said the girl just got b***hy with him. exhaust isn't sucking the air like it's supposed to.

if the contracts cover repairs then the complex has already broken it themselves and he is free to go

habitability is grounds for breaking a lease, as is landlord's refusal to make repairs.

Call and tell them you want out or that you will take them to civil court over repairs.

Tell him he needs to get a copy of the landlord tenant act in your area. There will be guide lines on what constitutes a breach on the landlords behalf as well as the remedy such as legally breaking the lease. Good luck.

I'd recommend you contact your local legal aid society. This is a tenant-landlord issue. Depending on what state you are in, they can force the landlord to do the repairs, and if necessary they can nullify the lease. In the meantime, one thing you can do is read the rental agreement thoroughly. Particularly, look for the section regarding repairs and maintenance.

You don't say what state you're in, but Kaptain is right. There is something called an implied warranty here. It is legally assumed when you rent housing that the housing is safe & fit for human occupation. Here is the California definition: "implied warranty of habitability - a legal rule that requires landlords to maintain their rental units in a condition fit for human beings to live in. A rental unit must substantially comply with building and housing code standards that materially affect tenants' health and safety. The basic minimum requirements for a rental unit to be habitable are listed in the Dealing With Problems section." Each state has its own laws, but they're very similar when it comes to Tenants' Rights. Now, as to what to do, are you looking to get out of a lease, or fix the problems? If the latter, consider this: I had a friend once who would pay the rent with a check made out to "XYZ Apartments and Jane Doe" - she made the check out to the Apartment AND herself. They couldn't cash the check until she signed the back of it, which she happily did once the repairs were made. They knew that she wasn't just withholding rent, and she was assured of attention when she needed something fixed. Worth a try. Best to you.

If you have proof they are not keeping the Common Grounds in order, and you have proof they are not making necessary repairs to his unit they're responsible for, (should be spelled out in lease) Then you might have grounds for breaking lease without penalties. I strongly suggest you collect all of your information and take it to a Competent Lease Lawyer in your area.
