Question
Credit experts, I need your input/advice/comments.......?
I had a credit card with Providian, which was brought out by Washington Mutual a couple of years ago, however I had already stopped paying the account before the merge. Now Washington Mutual has been bought out by Chase bank and they are trying to collect that debt from me. Can they do this? I have disputed the account on my credit report because it is listed as a Chase account, so is there any way they can actually prove this account is mine since when I was making payments, the payments were made to "Providian"?

You'll find out who is right when you receive a court order from the county judge authorizing a garnishment against your paycheck to pay a debt that you incurred, regardless of whom it was with. In the meantime, your credit rating is going to hell, so don't expect to get any decent loans in the future.

yes they can prove it but this will be based on the time factor as when you made a payment last, and did you pay this all off, as long as they can prove they bought the debt each time the banks sold out to someone else then they can collect. but it is a matter of the time factor

Yes, they can. As part of the merger/bank buyout, Chase bought all of WaMu's assets, including the loan they made to you. Chase has a reputation of being very aggressive in collections through the court system. If you know you owe this debt, start working with them to work out a payment plan, and don't spend your time with tricks like "disputing" the debt. If the judge figures out what you are doing (and trust me, judges will. Do you think you are the first to try this?).... the judge will make life very difficult for you. If you owe it, work out a way to pay it.
