Whos considered the responsible party on home property taxes? If your on the mortgage.....?

If your on the mortgage but not the deed to the home can you be held responsible for unpaid property taxes or is only the owner of the home liable. Divorce situation.... I own the home from my divorce. He signed the deed over to me, but the mortgage company wont release him from the mortgage. So is he still liable for the taxes or am I. I ask because I fell behind on the taxes and he claims that he can be held liable and it will ruin his credit report.

Sounds cut and dry. Whom ever is the owner in the eyes of the law is the person on the deed of trust. That means the owner is responsible. In a divorce situation, I would definitely contact a lawyer if you are the owner, if not you better hope the other person doesn't.

The owner(s) of record is responsible to the county. It has nothing to do with the mortgage loan. How your divorce settlement is structured is a separate issue.

If your ex filed a quit-claim deed on the property then you are the sole owner and are responsible for paying the taxes. You should get current on the taxes ASAP, even if you have to rent out a room or two to get the extra cash. The last thing you want is the government taking your house and selling it to recover back taxes. As long as you pay the mortgage and the tax bill on time, everything will be cool.

The homeowner (which means you) is responsible for taxes, unless otherwise stipulated in the divorce agreement. It only makes sense as well. He no longer has any interest in the property, so he has nothing to gain by paying the taxes, so why should he be legally responsible for the taxes? If I sign my car title over to my ex, does that mean I am required to pay the registration and license fees????
