Question

What can I do about a incorrect entry on my credit report?

Having been out of the country for 6 years and returning in April, I decided to run my credit report. My Experian report came back with an entry from a bad check collection agency in Missouri, claiming I had written a bad check at a Pizza Hut. While out of the country I did not write any checks or eat from any Pizza Hut. I disputed the entry thru Experian and they still refuse to remove it. What should I do at this point.

Dispute it again. IF this was a before you left the country entry it is probably outside the Statute of Limitaitons for collections. DO not open up a can of worms if this is 6 years old by calling them. Stay off the phone period with any collection agency.

Was it from a checking account you had (if known) and what did you do with checks from any former checking account(s)? Did you shred them or just throw them in the garbage or leave them in a drawer somewhere or other ID where a sibling or someone could find them? How long ago was the bad check and is it possible to get a copy of the check to see what ID was used to cash it? You didn't say if you were ever in Missouri. It might have just been someone with a similar name and your name was the only match found at the time. Or someone who knew you were out of the country may have opened an account in your name. Too many unknowns. Did you just dispute it on-line or did you write Experian a letter with whatever details you do have?

Most disputes are simply dismissed if done on line or you do not provide proper proof or file the dispute in a proper manner as outlined by the FTC. Go to the following web site and download the proper procedure to dispute with Experian. Do it in writing, forget calling. www ... You should also include a copy of your passport showing the dates your were out of the country. You can also file a dispute with FICO and the FTC on line at the following web sites www ... www ... Hope this helps answer your question

When you dispute an item through the credit reporting agencies, they use an automated system for the majority of their verifications. Unfortunately, Experian and the other CRAs don't take the time to verify debts correctly. Your next step is to write the collection agency, and tell them you don't believe the debt is yours, and ask them for a copy of the check and proof that the debt is yours. Send letter certified, return receipt requested, so you can prove they received your correspondence. Then wait for the results. If they don't reply within 30 days, or don't send conclusive proof that the debt is yours, they are in violation of the law. You can then report the collection agency to your state Attorney General's office and the Federal Trade Commission. You can even sue them. If they do send a copy of a check back, it is possible you may be a victim of identity theft. File a police report, and file a new dispute with credit bureau and include the information that you got from the police.
