Can a company withhold your check for credit card scam?
Hi. i work for a small company selling phones, I say around two weeks ago i took a payment for $800. the gentleman gave me an American express card i swipe it and the credit card machine couldn't read it. "i mean this happen to me with my chase debit card in the pass in Home depot so the cashier had to put it manually". So any way i also did it manually and the machine where you swipe the card said it was Approve! i also did and imprint on the card so i send it to my headquarter with a copy of the gentleman ID and they didn't say anything to me until three days later, its been two week and a half i was suppose to get my paycheck last Wednesday and its a week, i question them once and they told me wait until the big boss come back from his business trip. i been waiting patiently i want to do this in a right way so if any body can help me please respond back or Email me at nlfeliz@yahoo.com Thank you so much.

If the machine approved it then you are in the clear. I mean what are you to do? Take the decision yourself not to approve it when the machine gave it the go ahead?? No, you are not personally liable for any company losses. They may discipline you, but can not withhold pay for any loss. You need to be firm with them, and let them know that by statute they are required to pay you your earnings, and on time.

Sounds like you got scammed. As for keeping your check I would call your local employment or labor board. They are not supposed to withhold checks at all even if you made a mistake- they can fire you but not hold your check. nyb

The machine approved it so you are ok. You did your job. If they say otherwise you can sue them for the money and it'll be a VERY easy win.
