Help with sending a sublet deposit from out-of-town?

I am moving into a new city in July, so I found a sublet for 2 months to stay in while I can for a more permanent place. The owners of the sublet are asking for a pricey deposit to hold down the reservation for me before I can get there. I'm about to send the deposit, but am worried about a few things. How can I make sure that they won't just take the deposit money and refuse to rent the apartment to me? Do I have legal rights that I should know about? I already checked that the owners do actually live at that address (white pages). What other precautions should I take before sending out all this money? It is impossible for me to fly out there before I actually make the move- I can't afford it. Thanks for the help; it's my first time doing this.

Ask for a copy of the rental contract to be mailed to you. You will return it to them signed with the deposit check. Keep a copy of the check and the contract for your records in case something goes wrong. The problem you have here, is that you are not legally a tenant until they sign the contract and / or cash the check. If they don't sign, but cash the check, in most states you are a tenant as soon as they knowingly accept rent money from you. You have the rights of all other tenants and can take them to court for breach of contract just like other tenants.

These types of situations make me nervous---you have done some homework and the address confirmation is good. I just don't like the idea of renting things site unseen and without a personal meeting..Since you are unable to do this I guess you just got to trust..I would send them a check or money order-certified mail with receipt of signature and ask the owners to fax or e-mail the reservation confirmation as soon as they get it.. If they are honest people they will respect your wishes..you are coming in from out of the area and cant take any chances of getting screwed and this will establish a paper trail.., Do Not---Western Union money in a situation like this...
